H4 visa- pursue MS

Hello everyone

I am on h4 visa status I have come in August 14 I would like to pursue further studies

My visa expires on aug 2015 it's been 3 yrs I had valid busa but my hubby is on 3 + plus extension which can be extended .my concern

1) if I study on h4 visa will my visa expiration in aug 2015 be a constraint or can I continue as we get extensiom by his client ...

2)will I be eligible for instate tution fees as the cost is low than f1 visa..

3) I am bachelor commerce in graduation and pursued MBA HR 2 yrs as distance learning in India course and have 5 yrs work exp out of which 3 yrs is IT exp in SAP

Can I pursue MS here or or do I have to enrol for bachelor course then do MS cos I am confused as mine 2+3 +2 distance learning will my wrk exp be considered so I can take up MS. Degree ?

4) some university ask toefl some ask gre some ask both which are legal university n accredited can you suggest me some .

I being a BCOm background which are the MS courses which I can enrol apart from computer science , comp engineering and software engineering ...but I want to get into IT field ..

1.  As long as your spouse maintains H1B status your H4 status can be extended.

2. Depends on the state as each state has its own set of rules.

3. You can enroll for a MS degree.

4. Look for universities that ask both GRE and TOEFL with proper accreditation. Enroll in a state (public) or non-profit university. Stay away from for profit universities. In this way based on your MS degree you will be considered first under Master's quota while applying for H1B.

1. No problem with your H4

2. That depends on that school. You need to contact that school enrollment services for that

3. Applying school will have some requirements for MS. Check their website.

You can study just fine on H4. The H4 can be extended as long as your spouse is in valid H1 status.

As for instate tuition, that depends. Several states allow instate tuition for people in H4 status.

You need TOEFL and GRE. Avoid any university that doesn't require that. Such institutions are shady or outright frauds.

The university will determine if you need additional classes based on your undergraduate degree.

4) Additional requirements, such as standardized test scores, letters of recommendations, department applications are determined by each academic department.  So you can check if they need GRE.

International students must show English proficiency and thus TOEFL or similar approved test is required.

Dear Attorney,

      I am currently on H4 visa. And I have received admission for MS in two universities for 2015 Fall(full time). I am also eligible for H4-EAD and I have already applied for it on May 26 2015. Based on my current knowledge, EAD will come only after 3 months, by which my classes will have started. However, when I receive EAD, I would still like to continue my course and work in parallel . Am I legally eligible for converting my full time course to part time or online? 

 

Both the universities have part time/online study options available. But when I enquired with the universities, they informed that usually H4 students are not legally eligible for part time studies. Since H4 students could not work in the past, the people in university are not familiar with this scenario. 

  However, they are not sure what the rules are when this new H4-EAD rule comes to effect. They suggested me to consult with USCIS or attorney regarding this.

I would really appreciate if you can shed some light in this area.

If the university offers that course part time or online you can do that on H4. To be very sure talk with an attorney.

People on H4 could always study full time or part time. There is nothing in the law that prohibits that. The particular institutions may have stricter rules, or they don't know much about the H4 since there are probably not that many people on H4 enrolled there.

The EAD doesn't change any of that.
