EB2 to EB3 and again back to EB2

Hi All,

 

Currently, I have approved I-140 under EB2 category ( company A). I got a good offer from company B, but they will do GC processing in EB3 category only. I am thinking to take this job and after 3-4 years (just before my PD becomes current in EB2), I will move to another company C which will process my GC in EB2.

 

1) Is there any risk involved in my plan?

2) Is it a good idea to moved from EB2 to EB3?

3) Is it easy to move from EB3 to EB2 ?

1) Is there any risk involved in my plan?

There is always a chance of future PERM not being approved. You plan to have 2 GC applications filed so audits/ RFE is always possible based on application. You will not get audited because you filed too many applications so don't worry about that.

 

 

2) Is it a good idea to moved from EB2 to EB3?

does not matter. Depends on job requirements.

 

3) Is it easy to move from EB3 to EB2 ?
