Need help with DS160 form questions

Hi,

 

Someone who has recently filled in DS160 please help. My background: I was first in the US on F1, then got onto H1. I have one stamping done. 

 

My questions:

 

1) Have you ever been to US? In filling the details, it asks for entry date and length of stay. Does the length of stay need to match the visa length? For example, I first came on F1 (2 years validity), then got onto 1 (3yrs validity), but traveled one year into H1. So my date of entry would be when I came on F1 and length of stay would be 3 years (1 yar greater then the F1 visa length, though not out of status), is that correct?

 

2) Have you ever held a US driver license? Here do I need to eneter information of all US rivers license I have held previously? I have had other states licenses previously, but dont have the details. I can only enter details of the current license that I have. Is that fine?

 

3) Previous Us visas: There is a questions "Are you applying in the same country or location where the visa above was issued, and is the country or location your place of principal residence?" 

      I had my previous stamping done in Ottawa Canada, and I am going again to Ottawa for stamping, what should I answer here? Yes or No?? Although I am going to the same place, it is not my place of principal residence.

 

4) Has anyone ever filed an immigration petition on your behalf? 

       My employer has filed one, so I say yes, then it says Explain? What do I put here, what kind of explanation do I need to give? 

       And my wife is on H4, would she also need to say Yes here? and Explain?

 

5) Regarding Previous Work/Education/Training... do I need to enter al education from my high school onwards, or my Masters from US is enough? Or Bachelors from India and Masters from US is enough?

 

Any help really appreciated.

1) just enter the dates of travel . I did the same . i had similar condition of changing from F1 to H1 . no issue 

2) you can enter the current one and leave it . Or just mention other states but say do not know number .

3) say same location but not country of primary residence 

4) no clue but i think if you filed for green card you say no but i am not sure 

5) just enter masters and bachelors you should be good

As per my understanding. Here are the details.

ANS: Length of stay needs to be from the date you entered in US to the date you left. It does not count which VISA you were/are on. As long as you maintain the legal status, enter the ENTRY DATE to USA and LEAVING DATE of USA which gives the duration of stay in USA.

ANS: Enter the current DL information. That should be good.

ANS: Even though the first part is true, but as Canada is not ur primary residence, you should say NO here.

ANS: say YES: Explain: My employer filed for my Greencard in the employment based Greencard category on behalf of me.

ANS: The DS 160 form clearly states to enter the education information above the high school. So, you should enter the info from your Intermediate(or from PLUS TWO) to current(even if you are still doing any education in USA).

what should be principal residence if I am Indian citizen and staying in USA ( h1b non-immigrant visa ) ?

I am planning to visit India for stamping so wanted to check on below question:

 

Are you applying in the same country or location where the visa above was issued, and is the country or location your place of principal residence

 

I am applying in same country , earlier I applied in India but not sure what exactly the 2nd part mean. While filling ds-160 I answered Yes but wanted to double check.
