L2 EAD and H1

Hi,

I am on L2 EAD working for Employer A. My L2 EAD is valid till Aug 2016.

Since my Employer A will not sponsor my H1, I have found a consultant who is ready to apply for my H1-B in year Apr-2015.
1. What if my H1 petition gets approved,  Will I go out of L2 Status.

2. I want to continue on my L2 EAD with employer A even though my H1 gets approved through the consultant till L2 EAD is valid.

Just want to have H1 as my backup plan, is case my spouse gets changed to H1. Will it work this way. Please suggest what to do.

1. If approved as COS then you will be on H1B from Oct 1st. If approved as consular processing you continue to be on L2 status.

2. Let the consultant file H1B petition as consular processing.
