HawaiiGirl
I currently have a conditional GC through marriage to a US citizen which I received in May 2012. In May this year I applied to have the conditions removed. My husband is my sponsor and I have a co sponsor also. My husband supported and signed my I-751 application. I am still awaiting approval of this application. My husband has been threatening towards me and I am now planning to seek a divorce. I am concerned about my welfare and I am not living with him now. Should I seek a restraining order against him. He has threatened to kill me on one occasion and recently threatened to rape me. Shortly he wants to come to live where I am living. He is currently working away from Hawaii. I do not feel safe with him returning. Please can you tell me what the procedure would be for me to seek a divorce and do I then need to file a new I-751 and repay the filing fee of $590. Would it be advisable to have a lawyer if I need to refile a new I-751? I have not received an appointment for my bio-metrics and it has now been six months since I sent in the I 751. I have contacted USCIS and they have told me that they have received my bio-metrics fingerprint in early June. I have written to them several times to say I did not attend a bio-metrics appointment but they have told me in their replies that they do not require anything more of me at this time. This seems strange. Should I expect to have to have a biometrics appointment during this part of the process. I have my biometric's fingerprint taken before my conditional GC was issued.
