kranthi111 Posted November 21, 2014 Report Share Posted November 21, 2014 Hi, My H1B started from 01 Oct 2014 and I got notice from my employer that I will be laid off in end of November. In this case as I don't have job after Nov I have to shift to H4 through change of status. So my questions are 1) Who should file change of status? Me or my employer? 2) If I apply for change of status from H1B to H4 at the end of November, it will take 2-3 months to process and in the mean time a) can I stay in US till my H4 gets approved? b) I wont be getting any paystubs after November and is it ok to stay here without paystubs as I filed for change of status to H4 which is during the processing period? Please answer the above questions and suggest if I have any better plan. Thanks Link to comment
