Mom stayed for 3 months (10 Sep - 4 Dec) in 2014. Coming again in March 2015

Hello everyone...

 

My mom came to US on 10 Sep and going back to India on 4 Dec. (approx 3 months).

[she got 6 months stay this time]

 

 

She will be coming back around 10 March 2015. What do you all think? Will she be allowed to stay for 6 months?

A visitor has to spend more time in home country. She might get reduced time to stay in US.

DS ( duration of stay) on I-94 is at the sole discretion of the CBP officer. In general you need to spend more time in your home country.

Yes make sense. I am not sure what return date I should chose for flight. If I have to change the return date for the flight then there will be a significant cost.

Book return ticket with 6 months in mind and look for airlines that charges less change fee.

No way to predict which POE Officer she will encounter. No way to predict as to duration of stay. I would expect another 6 months . But if she returns in a few months after that they may give her a short stay.

In case in March 2015 if the officer at POE allows say only one or two months of stay. What are my options to request the extension? Are there any?

If you have a valid reason that can convince USCIS then you can apply for an extension. If not better for your mom to leave before I94 expiry.

You can request for EOS, but I think you need a good reason for that.

"why are you coming again so soon?" 

 

"This time I am allowing you to stay 6 months but next time stay longer in your home country before coming back here."

 

"Or else you will not get to stay 6 months here"

Good to know your mom entered US. But, note that it came with a warning. There is a possibility that she would have been flagged (I do not know if that is the correct term) and next time when she enters US there might be additional scrutiny.
