I was enrolled as a H4 student for MS in Pharmaceutical Manufacturing at Stevens Institute in Aug 2013. I was a full time on-campus student for Fall 2013(9 credits on campus) and Spring 2014 semester(9 credits on-campus out of 12 credits). Currently, I am a part-time student in Fall 2014(3 credits on-campus out of 6 credits) and wanted to transfer from H4 to F1 to get OPT. I have 3 credits remaining to complete my MS in Pharmaceutical Manufacturing and I am planning to take on Spring 2014 on campus. Can you also tell me, what is a requirement for OPT per USCIS? sagi85 Posted November 17, 2014 Report Share Posted November 17, 2014 I believe, one need to be in F1 status(as a FT student) for 1 year to be eligible for OPT. I don't think you are eligible to apply for OPT, contact your DSO. Link to comment

It does not say one has to be on F1 status during that one year. However, from what I read, some Schools insist being on F1 status for that one year. Link to comment

If he really believes that, and wasn't just trying to fight with me, he should believe what is on that website as well. So, he should retract his earlier statement ;) Of course, as I have said for a long long time, what is on some website, even a government website, is not necessarily true, as can be seen in this case. The law is what matters, not a website, not even a government website... So, chakrakr should either retract his earlier statement here, or apologize to me for trying to incite a flamewar ;) Having his cake and eating it too doesn't work ;) Link to comment

In particular, you didn't understand my point at all... The site shows that stuff published on a government website can not necessarily be trusted. The only thing that can be trusted is the law. The site shows that what is published is correct and CAN be trusted. BTW, did you show the law for H1 Amendment when moving in same MSA ? Or S-Corp not allowed by EAD holder ? Link to comment
