sunshinesun Posted November 14, 2014 Report Share Posted November 14, 2014 My B-1 visa got cancelled at the port of entry in the US Boston - reason being frequent travel and CBP not believing that I am not working in the US. I was also given 5 years ban under 212(a)7(A)iIWill this visa rejection affect my H1B visa if I get selected this time in the lottery? Do I stand a chance to apply for H1B in 2015? What is my company's responsibility in this matter? Do I need to serve the entire ban or are there any circumstances under which I can get a waiver. I read about 212(k) waiver. I am at peak of my career, 5 years will be too much to sideline my career. Any help is appreciated. Thanks Link to comment

jairichi Posted November 14, 2014 Report Share Posted November 14, 2014 Yes, the ban prevents you from entering US in any visa category for 5 years. H1B can be filed next year but your visa will not be issued due to ban. Talk to an attorney. Link to comment
