Finding answers Posted October 30, 2014 Report Share Posted October 30, 2014 Hello experts: My situation: Came to US in 2010 on H1-B, wife came on H4, changed company in 2013, got new H1-B and new I-94, new H4 for wife and new I-94. Wife went back to India this summer but she did not give her I-94 when leaving US (by mistake), She also took my H1-B I-797A just in case with her. When at consulate in Calcutta(for new stamping of H4), the consulate by mistake took my I-94 (I-94 from my I-797 A in place of taking I-94 from I-797 B which she should have given at the time of leaving). I did not go to India. My question is what difficulties this can this pose and what should I do to get a new I-94. DO I consider my I-94 void? Please let me know. Thanks Link to comment
JoeF Posted October 30, 2014 Report Share Posted October 30, 2014 This is likely to cause issues, because they now think you are outside the US. Why did you not take the I-94 from the notice? You are supposed to have the I-94 with you at all times. Discuss your situation with a good lawyer ASAP. Link to comment
