H1B extension approved while outside the country

Hello -

 

My H1B extension petition got approved while I am outside the country (India). I do have 2 months of validity left on the current visa. Can/Should I get the approval notice sent to me in India so that I can get a new stamping on my passport before I return to the US. Pls advise. Thx!

You can travel with exiisting valid H1B visa and new employer's I797 before your H1B visa expiry date.

Thanks but what about the last action rule which states that "....if the application is approved while they are abroad and they return to the U.S. on their original visas the new 1-94 issued upon their entry into the U.S. will trump the I-94 attached to the Notice of Approval and the 1-94 with the earlier expiration date will be controlling. In such situations, a new application for Extension of Status will be required...." Pls advise.

Yours was extension and not COS.
