maverick69
Hello, My initial H1B was with Company X and I have accepted job offer in Company Y while in US and got my H1B transfered. My visa with Company X is valid till 30-Nov-2014. I currently have the Approved Petition with my new employer Company Y which is valid till 30-Jun-2016, also same validity for I-94 (given as in I-797A). Recently, I have visited my home country and re-entered USA with my valid visa from Company X. However, my I-94 was given with a validity of my visa (with Company X) i.e, 30-Nov-2014. Please advise if I have to go for visa stamping before my I-94 expiry? or Can I have my current employer Company Y to file an amendment for I-94 extension? Please help. Thanks in advance! itsmeusa
You should either visit the nearest CBP office (available at all international airports) and bring this to their notice that even though you had a petition approved until Jun-2016, you were given I-94 until Nov-2014 only, they would correct it OR Before 30-Nov-2014, you must exit US and re-enter and get a new I-94 with validity until Jun-2016. maverick69
Thanks for your response! So, does the CBP Officer have the authority to correct it accordingly to the new petition? Also, I have found the following on cbp.gov. https://help.cbp.gov/app/answers/detail/a_id/1741/kw/i94/session/L3RpbWUvMTQxNDQxNjQ3Ni9zaWQvZ2c0bzlXNW0%3D What do they mean by this? Please advise. pontevecchio
Which petition did you show on entry? Link to comment
maverick69
I showed my visa from Company X and also, the petition from Company Y.. but the IO said the petition is not needed and it will be sync in the system. As I-94 is automated, I came to know that my I-94 was given till 30-Nov-2014 only a week later. Link to comment
pontevecchio
You confused him by showing both. Do as advised by itsmeusa. Link to comment
maverick69
I have contacted the CBP (Deferred Inspection Site) nearest to me and they have asked to fax my documents which I did. Now, they corrected it online and it is now updated on CBP 1-94 website as per my new petition. Thanks a lot "itsmeusa" for your help! Link to comment
