inuscan
My current employer has petitioned for the 1st extension of H1-B after the initial three years validity of my I-94. The current status of the petition is under RFE. In the worse case scenario of the petition being denied for whatever reason, does the law permit me to find another employment and have the visa transferred? Will the denial of extension cause any issue with the transfer? Will any one familiar with the situation kindly comment? Thank you Link to comment
jairichi
Yes, a new employer can file a cap exempt H1B petition. If denial is not due to your credentials you are fine. Link to comment
