Can I do COS from F1 to H4 when my I290B is pending against OPT denial ?

I received OPT denial notice in April. I filed I290B to challenge the decision but it is still in "Initial Review". Now, I think I should go for H4 as my spouse is on H1B. Now, since I am not in-status, what are my options to file COS ? Can I files COS in US or do I need to my home country to file COS ?


Should I wait for I290B decision?
