dravid Posted October 23, 2014 Report Share Posted October 23, 2014 Hi All, I'm doing H1 transfer to new employer(Joining On Nov 3rd) but if H1 transfer got late and i joined on Nov 17th,2014 my employer(desi consultancy) may not run paycheck for 17 days(Nov 1st- Nov 17th) . jairichi Posted October 23, 2014 Report Share Posted October 23, 2014 As long new employer files a cap exempt H1B petition before your last date with current employer then you are fine. If new employer files a cap exempt H1B petition 14 days after your last day with current employer then a RFE might be generated for latest pay stubs. If not provided your H1B petition might get approved with out I94. In that case exit and enter US with a valid H1B visa and new I797. Link to comment
