shravand007
Hi I am currently in h1b and I am diagonised with a health issue which is serious. Will I be able to stay in US for treatment by applying leave of absence? Can I use my employer health insurance to cover my treatment while I am on LOA? -Shravan Link to comment
rahul412
You can. Talk to your employer. Link to comment
jairichi
Sorry to hear about your health condition. I believe it is permitted and depends on employer's policy. Talk to a good attorney. Link to comment
Attorney_6
If the leave of absence needs to go beyond the point where a person would be considered to be in H1 status (an issue that should be discussed with a lawyer), and it is necessary to continue to receive care in the U.S., it may be possible to file to change status to a B-1/B-2 for medical treatment. Check with the employer regarding the steps required to make sure that the insurance continues (and the cost). Also check with the employer regarding any short term or long term disability coverage offered through the company. One other option that may be helpful at some point is a part-time H1B. H1Bs are not limited to just full time employment---they can be filed for part time. Thus, if there comes a point where it is physically possible to resume work, but only on a part time basis, that is an option for an H1 if the company approves. Link to comment
