Offer from a company listed in Non Compete agreement and H1 Transfer

Hello, 

I have received conditional offer letter from company A.
Condition of which states that I need to get waiver from my currently employer X on Non-compete agreement which has 12 months duration. 

Currently on H1 second phase and my current employer (X) is not willing to pursue my green card so I am forced to seek new opportunity. I am working as an engineer.

What are the ways to get non compete waived? 

I have stated it to the new company "A" that I am not sure if I have any such signed agreement and will let them know. 
Can I just say that I have not signed non compete? What would it lead to?

Don't lie. It would come back to bite you. You could lose your current job AND the new one, and you could be forced to pay lots of money to your current employer.

You need to discuss the non-compete issue with your current employer if you want to get a waiver.

Thanks for the suggestions. 

 

I have already discussed the situation with my current employer my director as well as vice president knows about the situation and are orally assuring that my move won't cause any issue but since it is multi-national company no one knows who is the authority who can provide me the waiver. 

 

I tried calling HR guys at different locations and most of them are not aware of who is correct person to deal with and are trying to find out correct channel to go through. 

 

My current employer hired me as a full time and was aware that I will need sponsorship, but is now stating that won't pursue green card and this is the reason I am seeking new opportunity. 

 

Also the new employer wants answer from me within 2 days.

Verbal agreement will not stand in a court of law. You need a written document.
