New H1 with I140

Hi,

 

Right now I am in India and I have already completed my 6 years of H1b and I have an approved I140 through my previous employer which is still valid. Now I am thinking for a new H1  with a different company. So do I need to go through the H1 lottery processing again on April 2015, Or can I apply for a new H1 anytime soon

A new employer can file a cap exempt H1B petition based on approved I-140.

You are cap exempt (no need to undergo lottery process) if your I-140 is still approved, you can use the same and prospective employer could ask USCIS to give you 3 years of extension.

You are entitled to 3 year extensions of H1 with any employer based on an approved I-140.
