I travelled to the U.S with H1B with employer A in May, 2014 and applied for H1B transfer in PP with employer B on Sep 30th, 2014. I have got an RFE on October 8th for employer-employee relationship. We are in the process of getting the client letter. Employer A is in CT and Employer B is in GA. I started working for Employer B with the H1 Transfer receipt number and currently living in GA. Now i am planning to bring my wife to the U.S. She doesn't have any H4 stamping yet. Since i don't have my new H1B petition yet, can i bring my wife with my old H1B? If so, what all are the documents required? Won't it be a problem since the employer location changed and the place of travel changes? I am actually worried about the quesitons/issues she might encounter in the port of entry. Please advise. Link to comment
jairichi Posted October 22, 2014 Report Share Posted October 22, 2014 No, you can not. You need to wait for H1B petition approval with employer B. After approval your spouse can travel with valid H4 visa and a copy of your employer B's I797. Link to comment
