Currently on L1 which is valid till next year. My prospective employer had filed H1 this year and it is approved now.

 

1. I am in US working under L1 visa. Can I continue with current employer under L1 visa until next year and then switch to H1 visa.

 

2. Should I apply for change of status and start working with prospective employer.

 

3. Per immigration, how many days or months within which the applicant should start working under H1.

 

4. Once H1 is approved does it invalidate the L1 visa status?

1. If H1B is approved as COS then you need to stop working for L1 employer. To work for L1 employer you will need to exit and enter US with a valid L1 visa and I797.

2. Refer 1.

3. If approved as COS you have 60 days to report to H1B employer. But, have to stop working for L1 employer from the date of approval.

4. If approved as COS then the answer is YES.

Instead of COS(Change of Status) Can I apply for a new H1?

I should be able to continue on my L1B even after I obtain my new H1B.

Depending on the market and the Job I get, I can decide to switch from L1B to H1 as per my choice.

Can I do that if I apply for a new H1B. Please let me know.

Yes, let employer file a H1B petition as consular application. After approval you can move to H1B employer anytime as long as H1B petition is valid.

question 2) If my Consular H1B got approved can I switch to my H1B sponsor any time(as long as the petetion is valid) while living in USA?

or

Should I go to INDIA  to get my H1B visa stamped and then join my H1B Sponsor?

Basically,Is there any rule to go out of US to get the H1B stamping done?
