Employer billing rate

Hi,

 

I work on percentage basis with my employer. Is the employer legally required to divulge the billing rate he is gets from the client ? Simply put am I entitled to know the right billing rate ?

No you are not entitled to know the client's billing rate. Because client is not paying you directly.

On H1 you should get yearly salary, I think that's what mentioned on your H1 petition.

No, you don't.

On H1, you get a salary, not a percentage. Check the LCA. There is no percentage there.

What would be your "percentage" if you are without a project??? You still need to get paid then, so you are not on a percentage basis.

On H1, you ALWAYS get a salary, not a percentage.

Any percentage could only be payment above the salary listed on the LCA.

Since you are on Pecentage basis , you should usually know the rate. There is no rule as far as I know whether he divulges the rate or not. Usually Percentage basis  candidates talk to prime vendor about the rate directly.

And that is not allowed on H1b. H1b requires beneficiary to paid every pay cycle, that is only possible by annual salary.
