ch2rl Posted October 17, 2014 Report Share Posted October 17, 2014 Hi, My previous employer filed for i-140 and got approved in 2009 which has May 2008 Priority Date. I moved to new employer in 2012 and they did file my GC and they retain my previous Priority date that is May 2008. New Employer filed 140 and 485/130/765 concurrently in Aug.2014. 140 Got approved in premium processing, Now my question is When can I get my Green Card? One of my friend told me to file case in interfile and get it approved by calling USCIS or email to EBUPDATE.TSC@uscis.dhs.gov Please suggest me what should I do? Do I need to just wait till it get approved or Do i need to file in interfile? Am I need to worry on retrogress of EB2 or should I be fine to get Green card this year? All appropriate answers/sugesstions would be greatly appriciated... Link to comment
itsmeusa Posted October 17, 2014 Report Share Posted October 17, 2014 You will get green card in due course - not this year for sure (just my opinion). Your case is not the case where interfiling comes in picture. Interfiling comes in picture when you had already filed I-485 in the past (say in EB3) and now you ported PD from EB3 to EB2, then interfiling request could be submitted to USCIS to consider newly approved I-140 to process already filed I-485. Attorney_6 Posted October 20, 2014 Report Share Posted October 20, 2014 There has to be a visa number to get the GC. If this case is EB2, India, the dates are retrogressing in November. Thus, it will have to wait through the period of retrogression to be eligible for approval. It is correct that this has nothing to do with interfiling. Link to comment
