My visa got expired during my 2 year stay but got my extension approved till November 2013. I came back to India in Jan 2013. I got my visa stamped in August 2013(before the petition expiry) but got a 3 yr visa stamped even though my extension petition was only till Nov 2013. I traveled to the US again in Jan 2014 but was denied admission at the port of entry due to the expired petition document (The 3 year visa validity was not considered). My 3 year L1-B visa was also cancelled. I'd like to know if I could go ahead and have my employer file my L1-B visa again immediately or if I need to wait for the complete year (Till Jan 2015) before doing so. jairichi Posted October 13, 2014 Report Share Posted October 13, 2014 A L1B visa without a valid petition will not give you entry into US. Didn't you or your employer know about this? Let employer file a new L1B petition after you stayed outside US for 1 year so that your clock gets reset and you are eligible for fresh 5 years. Link to comment

I had come back from the US in Jan 2013 and completed my 1 year before leaving again earlier this year. I was not allowed entry in US this time. So i believe my clock has already got reset during the 2013 - 2014 stay. So just wanted to confirm if i still need to wait till Jan 2015 to get it stamped. Thank you! Link to comment

Your clock would have reset in Jan 2014. Let employer file a fresh L1B petition to get 5 years. Link to comment
