immigrationmatter
Hi, I have applied for my mom's B2 visa extension on August 31st. Her I-94 expiry date is October 11th. 1. If she doesn't get any response (Approval/Denial) from USCIS before October 11th, can she continue to stay in the US based on the Acknowledgement receipt? 2. In this case, will her stay be considered legal? 3. If it gets denied, how soon she has to leave the country? Any information here would help me a lot. Thanks. Link to comment
jairichi
1.Yes, she can stay. 2.Yes. 3. Same day or next day. If denied after I94 expiry then her visa automatically stands canceled. Link to comment

immigrationmatter
My mom's extension was approved after she left the country. I have few questions: My mom stayed here for 8 months. Her extension got approved on the next day after she left. 1. If she wants to come back again within 2 months, would that be an issue? The reason of the visit is to celebrate my son's birthday. 2. Is there any guideline/law which says she has to stay out of USA for certain time before reentering? Any information here would help me a lot. Thanks. Link to comment
jairichi
1. She might get less I94 validity. 2. It is expected of a visitor to stay more time in a year in their home country. No rule exists. Link to comment
immigrationmatter
Is there a possibility that she will be sent back from the Port of Entry? Has someone encountered the similar situation where the parents/in laws are sent back from port of entry due the extension of stay in the previous visit? Thanks. Link to comment

Chances to be sent back for old age parents are very rare. Link to comment
