user1981 Posted October 2, 2014 Report Share Posted October 2, 2014 Hi There, My previous H1B and I94 expired on 09/30/2014. My Employer filed the petition in time and we had the H1B approval well before that date. We also received the I797 approval notice well before that date. Somehow, my employer and I missed to check the I797 properly when it arrived. Today when I was trying to get my driving license renewed, I noticed that I797 has I94 portion voided on both pages. One more thing, as we chose premium processing, the approval email from USCIS contains I94 number. So, my concerns are as follows. 1. What does this mean? Does it mean that USCIS did a typo or there were some other reason to issue a I797 without I94. 2. Do I need to leave the country as soon as possible, as I dont' have valid I94 anymore, or I can I stay in the county till 14th Oct, as I already have planned a trip to India. 3. Should I contact the USCIS to get corrected copy and then leave the county as I am planning to get my H1b Visa stamping. Thanks Manish Link to comment
itsmeusa Posted October 3, 2014 Report Share Posted October 3, 2014 Ask your employer / lawyer to contact USCIS immediately to clear up this issue. As your H1b was filed under PP, they can even email to USCIS and get this sorted out fast. Link to comment
