cskdrstt
I came to US on a H4 Visa and recently my H1 got approved. I went to SSN office today (Oct 2, 2014) and they told me that I will need H1b Visa stamp to apply SSN. I know people in the same scenario who dint to have h1b stamping got SSN. What should I do? Should I go to a different office? -CK Link to comment
itsmeusa
Yes, you don't need H1b visa stamp to apply for SSN. Link to comment
jairichi
Was your H1B filed when you were in US on H4 status? And was it filed as COS or consular processing? If your H1B was approved as COS with an I94 attached to I797 you should be fine to approach another SSN office. Otherwise you will get the same reply everywhere you go. Link to comment

cskdrstt
I received I-797 without i94 attached. I printed the online I-94 and its shows H4. April 1st week 2014 - H1b was filed.May 20, 2014 - H4 was approved.July 7, 2014 - H1b was approved. Link to comment

You need to exit and enter US with a valid H1B visa and I797 to be on H1B status and then apply for SSN. Link to comment
JoeF
I received I-797 without i94 attached. Then it wasn't a COS. You are still in H4 status. Link to comment
cskdrstt
We went to a different SSN office and found out that employer has to file Change of Status. Then we can apply for SSN with the new I-797 (with I-94). or go out of country to get Visa Stamped. Link to comment

JoeF
If I go to India and if the H1B Visa gets rejected, will I be able to enter US with H4 Visa? Why do you think the H1 visa stamp would get denied? Is there something fishy with the employer? Link to comment
jairichi
If I go to India and if the H1B Visa gets rejected, will I be able to enter US with H4 Visa? Yes, as long as H4 visa is not canceled by US consulate. If canceled you will need to apply for H4 visa. Link to comment
cskdrstt
There is nothing fishy about the employer. I don't anticipate anything bad. I am just trying to understand all the options as per statistics. Link to comment

jairichi
As an add on to this question, What determines whether your H4 status is voided after you are issued a H1 visa while on H4? If H1B's I797 has an I94 then status is no longer H4. Link to comment
JoeF
As an add on to this question, What determines whether your H4 status is voided after you are issued a H1 visa while on H4? The I-94 determines the status. The last I-94 received counts. Link to comment
