VLAD02 Posted October 1, 2014 Report Share Posted October 1, 2014 I got my visa extended till June 2017. I went to India this summer and got my H1b extension. On the paper I94, the expiry date is Jun 2017. However the admit until date on I94 website is Oct 2015. (My passport expires in Oct 2015). Is the passport expiry date reason for the I94 admit until date to be less than that on paper? Also if I reissue my passport, will I94 admit date be automatically updated? If anyone has any idea on this, please reply. Thanks Link to comment
JoeF Posted October 1, 2014 Report Share Posted October 1, 2014 The admission can only be until the visa expiration or passport expiration, whichever comes earlier. Once you renew your passport, you can go to a CBP office in the US (they are at the big airports) and get the I-94 extended. Nothing is automatic. Link to comment
jairichi Posted October 1, 2014 Report Share Posted October 1, 2014 Yes, your passport expiry date is the reason for getting an expiry date of Oct 2015. Once you renew your passport your I94 does not extend automatically. You need to exit and enter US with a valid H1B visa and I797 to get new extended I94. Link to comment

I mean if I do not travel to India till Oct 2015 and the I94 admit date stays the same as it is now, will that create any issue? itsmeusa Posted October 1, 2014 Report Share Posted October 1, 2014 I-94 gives you legal stay in US. Once it expires, you can no longer stay in US. H1b petition gives you authority to work in US as long as I-94 is valid. Link to comment
