Can I file L1 visa when I have H1B active

Hello,

 

I have H1b visa with I-140 approved and completed 6+ years in USA. Now I am India and stayed 1 + years.   Same company is now asking us to file L1A visa.   My question is, can I file L1 visa when I have already have valid H1b visa from same company.

 

  If not, can I wait till H1b petition get expired and then file the L1 visa?

Your employer can file L1A petition for you.
