sobhanbabu123 Posted September 21, 2014 Report Share Posted September 21, 2014 Hi ,My Labor is pending more than a year( in the green card processing ) and My h1 expired around 4 months back , I applied the change of status H1 to F1 and that is also in pending status( Initially is i got query and my lawyer replied for query ) .If labor is pending more than a year can I apply H1 one year extension ? Looks my employer is not aware and he is seeking information from lawyer ,But they are busy and They are not responding . ashuneel Posted November 1, 2014 Report Share Posted November 1, 2014 If your H-1 extension is denied you will be out of status for last 4 months. Employer/ lawyer should have upgraded renewal petition to premium process before your 6 yrs are up. not sure why you need to change to F-1 but you can get 1 yr extensions until PERM is approved. After I-140 is approved you can get 3 yr extension. Link to comment
