atz
Scenario: Employer A files PERM & I140 while on H1B & both got approved in 2014. What if I leave the employer and move to another country & then come back to USA after say 4-5 years and apply a new PERM through employer B. would I then be able to recapture my earlier PD that I got before I left USA? Need to make a decision soon. Would really appreciate your views in this matter. Thanks Link to comment
atz
Yes. . Thanks pontevecchio. One thing I forgot to include in my original question is that when I leave my employer & country, my original employer A is most likely going to revoke I140. Will I still be able to retain PD when I return to USA and start new GC process with employer B? Thanks Link to comment
pontevecchio
As the interpretation stands today you can still keep the PD in the absence of any fraud . Obviously the new process starts from scratch,, PERM etc. Link to comment
