My labor was expiring on 13 Aug 2014 and he sent my I-140 application to wrong office on 11 Aug . Wrong Address : Premium ProcessingUSCIS Nebraska Service CenterP.O. Box 87103Lincoln, NE 68501-7103 Correct Address : 2501 S. State Highway 121 Business Suite 400 Lewisville, TX 75067 By the time my I-140 application reached to the correct address, my LC was expired on 13 Aug. So I received I-797 explaining that I-140 got rejected because of LC expiry. What are the option in front of me now ? I really appreciate your help. Link to comment
itsmeusa Posted September 18, 2014 Report Share Posted September 18, 2014 Your PERM is expired now, the most you could ask your lawyer to try to file it again with the cover letter mentioned the honest mistake. If it's accepted, well and good. This is a long shot. Otherwise, you are back to square 1 and need to start PERM all over again. And this time, go find competent immi. lawyer. Link to comment

Is there anything else I / my attorney should be doing like. Follow up with USCIS. Calling USCIS and Will talking with supervisor help ? Link to comment
itsmeusa Posted September 19, 2014 Report Share Posted September 19, 2014 As a beneficiary of I-140 application, you have no role to play. Only your employer or lawyer could contact USCIS. Of course, it's up to USCIS to re-consider and accept I-140 application. If they don't, there is really no case here as it was lawyer's mistake. Link to comment
