EB2 Experience Letter Difficulty

Dear All,

 

I worked 18 months as Staff Accountant on H1B visa with company A

 

Then I worked 27 months as SAP Business Analyst on H1B visa with company B

 

Company B is willing to file EB2 and it’s immigration attorney has asked for experience letters for atleast 2 years in field of SAP Business Analyst from previous company whereas Company A is willing to give experience letter as Staff Accountant only. Immigration attorney from company B says that current company’s experience of SAP Business Analyst cannot be utilized for 2 year work experience requirement needed in EB2.

 

How can I fulfill 2 year job experience requirement?  Any thoughts?

2 year work experience for Eb2 - I am assuming you have master's degree. In my opinion, your case should be fine even if you get Staff Accountant experience. There is no law / rule that restricts prospective employer to recruit you / file your GC in the same job title as you previously held. As long as your job duties in "B" match with the job duties you had in "A" or if there is a natural progression in your job duties from "A" to "B", it should not be a big problem.

Yes, I do have a masters degree from US university.

 

Unfortunately, my job duties as Staff Accountant (Company A) do not overlap or match with my job duties as SAP Business Analyst (Company B).

 

Is it true that Company B cannot apply for GC as SAP Business Analyst just based on my 2 + years experience in Company B? In other words, do I have to get experience letter from previous employer only?

You cannot fake exp letter..doing that will get you banned from the US permanently!!!

 

Thanks but "fake exp letter" was never alluded to anywhere in the post. In my situation, jobs in both companies were / are high paying and genuine jobs.

 

I am a trained accountant and have used SAP as part of job function. Company A hired me as Staff Accountant for accounting duties in finance department. Company B hired me as SAP Business Analyst duties in IT department.

 

Now at the time for filing for GC I have this expreience letter situation hence I am seeking more information.

Let me give one example - I don't know much about accounting  / SAP. Say you were a software engineer and one of your job duty was to code / unit test and fix defects. Now you are a programmer analyst and your job duties is design, reviewing architectural documents etc. You may find that job duties are not really matching, but this is natural progression of job duties when you have moved from software engineer to programmer analyst. Tomorrow you could be a project manager and job duties would be entirely different from what you did as a software engg or programmer analyst. But it should be a natural progression. 

 

If you apply the same thing to your accounting world, probably you would be all set with that 27 months of experience.

 

For smoother GC process, employer usually asks experience gained before joining them as a qualifier.

HAHAHAHAHHAHA reminds me of our good old OMSHIV who FAKED every possible doc in USA to obtain a GC back in the day...and now famously asking his other fellow desi to not do it, typical desi example: thanks :)
