I94 expired, i797 is not expired.Can i change the company now

Hi All


 


My i94 expired and visa stamp duration expired but my i797 B date is not expired. My h1b extension is in progress. Below are the details. in these case How can i change the company??? Do i need to wait until i get my visa extension is done?? Kindly suggest.


 


 


VISA stamp expiry date: 30 MAY 2014

 

i94 Expiry date : 30 MAY 2014

 

i797 Expiry date : 30 SEP 2014

Don't think to change company in this scenario.

 

Assuming your H1b extension has been filed before 30-May-2014, if not, you would counted out of status from 1-Jun-2014 until the date when your H1b extension papers reached USCIS. Reason being your I-94 expired on 30-May-2014.

 

In this scenario, you are allowed to work for 240 days beyond the I-94 expiry date. After these 240 days are over, if your H1b is still pending, you would be allowed to stay until the decision is made, but not authorized to work.
