i140 pending since December 2013

Hi All,

 

My i140 application(filed in EB2) is in initial review since December 2013, my employer has filed it in regular processing. I still have 3 years of H1B left, looking at the latest proceedings H4-EAD and possible executive action on EB2 numbers I'm eager to get it upgrade it to PP. But my employer is warning me that most premium cases will get RFE, is it true? Or should I wait for more couple of months?

forget about the H4-EAD situation...thats not going to happen!

Generally, premium processing requests do not increase the chance of an RFE, rather, the merits and documentation of the intial petition do.

Forget about H4 EAD for now. Make sure your I140 is approved without RFE's, PP will not increase the chances of RFE that's not true. Your employer doesn't what to upgrade it to PP.

My employer tried upgrading my case to premium, but it seems uscis revoked the upgrading request due to some security check is in progress on my case..

Does anybody have idea how long a security check goes on?

Here is the timeline of my i140

Dec 2013 - filed

May 2014 - 1st SR raised

Dec 2014 - 2nd SR raised

April 2015 - Upgraded to premium

May 2015 - Approved after a simple RFE
