Hi All.

 

Quick question on sponsoring my brother-in-law for a visitor visa. Currently I am on OPT working for a client through my employer.I have valid F1 visa and my OPT is valid till March 2015. Can I sponsor visitor visa for my brother -in-law? Please let me know.

Their is no sponsorship for visiting visa. Moreover F1 student cannot sponsor any type of US visa.

The consular officer generally considers various factors like applicant’s strong family, financial and social ties to home country, purpose of trip, and non-immigrant intent while adjudicating a B2 visa application. However, the burden of proof rests with applicant to overcome the presumption of immigrant intent under § 214(b) of Immigration and Nationality Act. It is always better to carry evidence that his/her inviting relative or friend continues to maintain a valid immigration status in the U.S. and other documents to evidence that the applicant will not become a burden on the U.S. public funds.

Sorry for the confusion. My intention in the question was, do I need to give a letter addressing to the US consulate that I am inviting brother-in-law? He is currently working in India and should be able to bear all the expenses.

In that case should I write a letter or noothing is required from my end?

You got nothing to do, just concentrate on your job. Your BIL should handle everything by himself, no need of any letters or documents. Just your address is required, if he is staying with you during the visit.

In most occasions, the officer adjudicates the B2 visa application based on information available on DS 160 and elicited over the counter. However, as indicated earlier it is always good (not mandatory) to carry evidence that the inviting relative of friend continues to maintain a valid immigration status in the U.S. and letter could evidence the continued relationship with applicant.
