Haripavank Posted September 2, 2014 Report Share Posted September 2, 2014 Hi Team, As always I bank upon advice from you, request your inputs for the following: I am working for a company A, since 4 years in USA on L1 visa and nearing visa/I-94 expiry soon. the company A is planing to file extension for me. I have been receiving offers from company B to join them My question is: Can I join the company while I am in US on L1 and switch to new company pn their L1 If so, and otherwise what are the other options that I have to join company B, while I am still in USA and not leaving and coming back? jairichi Posted September 2, 2014 Report Share Posted September 2, 2014 Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and Be seeking to enter the United States to provide service in an executive or managerial capacity for a branch of the same employer or one of its qualifying organizations. Do you fulfil these requirements with company B? Employer B has to file a cap subject H1B petition next April, provided you have not reached the max allowed stay of 6 years. Link to comment

Please respond with your suggestions. Thanks, Hari For a new L1, you would have to have worked for the company abroad for at least a year in the last 3 years. Since you didn't do that, company B can NOT file an L1 for you. They could file an H1 for you in next year's quota. Link to comment
