h1 stamping on extended 797, i have no stamping on current one

Hi

 

i have converted from F1- H1B , graduated in 2009 dec, worked on opt(used full opt time) and started my first h1B on jan 2nd 2012. I have no stamping currently on that first H1B. It expires on Jan 1st 2015. I have applied for extension and got my H1B extension approved (jan 2nd,2015 until Jul 2017).

 

I am planning to go for stamping in Canada on Sep 15th, 2014 on the new  extended I-797. My question is

 

1. should i put in both my petition nos in DS-160 form?(currently i just enetered my extended petition no)

 

2. will i be able to come back to U.S after my stamping(on sep15th,2014) on the extended I-797, i ask this because my extended I-797 does not start until Jan 2nd,2015?

 

3. will the consulate give me visa stamp based on both I-797's?

 

what should i be doing in this case? Appreciate all the help

But are you sure that i can enter US after my interview when i apply for visa on my new petition which starts from Jan 2nd 2015?

Will they give me a visa stamp from the date i attended interview(Sep 15th,2014) till my new extended I-797?

Visa will be stamped with a validity from the date you attended interview.

I was in the same situtaion 2 months back.

 

I put the New DS I797 Number in DS160

and showed both the I797 at the interview. But they took my new I797 along with my passport for the stamping

I got the stamping till my New I797 expire which is Nov 2017.

 

FYI- My case is exactly like yours.

Graduate in Dec 2009

H1b started in 2012

First H1b Stamping with extension.

 

No issue at the entry.

Stamping done in Jamaica.

You have to enter the Petiton details of the NEW petition in DS-160.

 

During the Interview process tell the consulate officer that you have two petitions. This is called Overlapped petitions as told by the consulate officer to me.

 

I had same situation like you ,having two petitions.  I got the visa till the end of latest petition.

 

In the Annotation section of the visa they specified both the Petition Numbers.

 

In Port the Entry the CBP officer checked both the I-797s.

Hello,

Looks like I'm on the same boat. Here's my situation:

I've an appointment for H1 B stamping at Ottawa on 12 Sept. 2014. This is my first ever H1 B stamping.

 

1. First H1 B approved for an year (01 Oct 2013 - 30 Sep 2014). I was on F1 before (graduated in May 2011) which expired in Dec 2013.

2. Applied for extension in May 2014 and was approved for three years i.e. 01 Oct 2014 - 30 Sep 2017.

3. I've been with the same employer and client for 3 years.

 

My worries are:

1. If I stick to the original plan and attend the interview on 12 Sep 2014, what will be my expiry date on the visa... Sep 2014 or Sep 2017.

 

2. If everything goes well, will I be able to travel back into the States without any issues at the POE. And what about the date on I-94.

 

It might seem very last minute, but any help is appreciated.
