I am working in US on EAD since 2010 ( I-485 was filed by my parents when I was 20) and it was pending till last year . but last year my 485 was denied Sept 2013 and i am not working at this time . we filed MTR but there is not update as of now. it has been 11 months .I filed my H1b this year . Can I go to Canada for H1B stamping I never had H1B before.Do I need to submit non immigrant wavier before going to stamping Do I need to mention that my I 485 denied Thanks rmh Link to comment
pontevecchio Posted August 31, 2014 Report Share Posted August 31, 2014 You can go to Canada. H1 is dual intent and allows Immigrant Intent. Any reason why you are not asking the Lawyer who filed your H1 and/or MTR. They will be able to help much more than a forum. Link to comment
