In future if i wish to change status again to H1B, can i apply for GC process using my H1B ? 2. If Yes, say i apply in EB-2 category , How much time does it take for approval of i-140 form ? If Yes.,say i apply GC using H1B and i-140 also approved within 6 months ...in that case can i get extension beyond 6 yrs ? ..once i140 is approved do we need any other document be be approved by USCIS for extenstion? And say i apply GC using L1 but not using H1 (means don't switch status again on H1) ..will i be eliglible for extension under L1 ..Is that correct ? Appreciate ur reply. Link to comment

Company A then sponsored my L1-B visa and I came to USA in August 2013 (visa valid till Feb 2016). I opted for COS from L1-B to H1B in Feb 2014 and have been on H1B since Feb 2014 working for Company B. recently Company A has confirmed filling GC and I now intend to move back to them under L1-B visa issued earlier (They are OK fo rme rejoining them). As I had spent more than 1 overseas, I hope I am eligible for EB1. Could someone please clarify - 1. Can I change status from H1 to L1B? 2. if I join them back in USA, am I eligible for EB1 (assuming I had worked with them until 2013 in India) 3. What is the COS process from H1 to L1? Considering L1B visa is valid till Feb 2016, can I just move out of country and reenter under updated visa category (L1)? Appreciate your help. Regards A Link to comment

Did your employer A or attorney tell you that you are eligible for EB1? 1. Yes. 2. No. 3. 3 to 4 months by regular processing and 15 calendar days by premium processing. Yes, you can exit and enter with valid L1B visa and I797 provided L1B petition is not revoked by employer. Link to comment
