can i apply I-140 under EB3 skilled worker category?

Hi,

 

My Employer has filled Labor for me and it got approved, He is ready to file i-140 but the problem occurs with the Job Description he has mentioned in the labor, he has mentioned

Master's degree required for that position, But unfortunately i have master's degree from non-accredited university, So i can't use that degree to file under EB2.

 

My question is can i file under EB3 Skilled Worker Category with this labor? i have BS+4 years of IT experience.

 

Can some one please help me on this.

That LC can NOT be used by you, since you don't have the required degree.

The process would have to start from scratch for a different, lower position.

did you mentiion to your employer that your degree is not from accrerdited univ.
