Aashish001
Background: My L1B visa maxed out in July 2014 when I completed 5 years in US, and I returned to India. My questions are 1) Can I apply for L1A visa now, (I am already working in managerial role), or do I have to wait for 365 days outside US before filing? 2) Can my company file for my H1B visa in April 2015? Appreciate your help. Link to comment
jairichi
1. If your employer files and it gets approved you will get 2 more years. 2. Yes and if approved you will get 1 year. Link to comment
Aashish001
Thanks for prompt reply. I want L1A to be filed but my employer has asked me to wait for 365 days. Is there any official online documentation on USCIS site which I can use as reference to ask my employer to go ahead and file for L1A now? Link to comment

If employer files after you stay outside US for 365 days (July 2015) you are eligible for 7 years on L1A. I believe that is what your employer is trying to do. Link to comment
