Shrestha Posted August 20, 2014 Report Share Posted August 20, 2014 If my I-539 (COS H1B-F1) gets filed 42 days before my H1B expires then? 1)How much issue is in the fact that I couldn't file my I-539 45 days prior to my H1B expiring? 2)Start my classes before I-539 gets approved? 3) What if I lose my job 32 days before my H1B expires and I have my I-539 in progress, am I going to have to leave the country before starting school? Attorney_22 Posted August 20, 2014 Report Share Posted August 20, 2014 As long as you have a valid I-20 and a timely filed COS petition you can begin classes pursuant to the I-20 included with the COS petition even if the petition is still pending when classes begin.
