Recapture Priority Date after I-140 approval

Hello,

    My first I-140 was approved with Priority Date August 2007. After I joined new company, I have a new I-140 approval.. but, the Priority Date from previous I-140 has not been ported. My attorney said, he will do during the filing of I-485. But, based on my research online, I see that Priority Date should have been already ported during recent I-140 filing.'

 

I am waiting for Priority Date yet..

 

Questions:

 

1) Since, my PD has not been ported, can it be done during I-148 filing as per my attorney?

 

Both I-140 has not been revoked.

 I think that you can request USCIS by letter with your old & new I-140 approval copies.

Check with your attorney
