justaquery Posted August 1, 2014 Report Share Posted August 1, 2014 All, I had a H1b in the US and worked for about two years and then I changed my status to H4.Now after 1.5 years gap I want to move to back to H1b. My H1b visa and I 797 has expired. I have a valid I94 (H4) till Aug 2015. Can I change my status back to H1b? If yes, then what all documents will I need? Do I still need to show two year old paystubs? Will it be just a change of status or extension of H1b as well? Will it go through the H1b quota again? Thanks for your reply in advance. jairichi Posted August 1, 2014 Report Share Posted August 1, 2014 An employer can file a cap exempt H1B petition along with COS and on approval you can start working for employer immediately. You will need the H1B approval notice with previous employer. Link to comment
