BC for 485

Hi, my employer told me that I need to have BC for my 485 approval but unfortunately I don't have one.

 

 

I was going through Indian consulate website and their it's mentioned that they do provide a birth certificate if I have original passport and other documents.

 

So can I use this certificate for my 485 approval??

No.

 

You need to get a Non Availability Certificate from the  municipality where you were born  (it is called Form 10) .   You need to send --

 

1) The Non Availability Form

2) Two affidavits from your parents /  other close relatives who can confirm the date/time/place of your birth

3)  (optional) Your school certificate showing your DOB.

 

For affidavits,  it can be done in India .. pretty easy.

 

For Non Availability Form,  if you do not have anyone in India who can go to Municipality office ,  try some concierge services in India which caters to NRIs.

I don't agree with this.

 

An Indian Attorney Notarized Affidavit for Birth Certificate works fine ===> it has worked successfully for one of my family member when they got their GC an year ago. He did NOT provide any NA form.

It does not matter  how your family member for a GC .. they might have got in error.  What matters is the LAW .  The Law (8 CFR 103.2 (b) 2 (ii) )    says

"Where a record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority."
