binu.sale
I work for a good fortune 100 company on L1 as permanent employee..I have my COS to H1 approved through a consulting company (small company who send me to contract jobs)..which one will be a good option for me? My current employer may try for H1 in the future but no timeframe guaranteed. And agian going through lottery is a pain Link to comment
jairichi
Stay with L1 company. Since your H1B is approved your current employer can file a cap exempt H1B petition anytime. Link to comment
JoeF
Why do you think you would have to go through the lottery again? Once an H1 is approved for you, and you haven't used the full time, an employer can file an H1 at any time. In general, FTE is better than consulting jobs, in particular small desi consulting companies are bad, because they tend to screw people over, e.g., by asking for money for an H1, by not paying on bench, etc. Link to comment
pontevecchio
Since you have your H1 petition approved you will not be subject to the lottery/cap until your total time L1B plus H1 exceeds 6years. Link to comment

You know how good is your current employer is when compared with a small consulting firm (body shop). Avoid consulting firms, stick to your current employer. Link to comment
binu.sale
But what if the consulting company revoke my H1B ? I will lose H1 and again have to go through lottery right ? Link to comment
binu.sale
also I heard that if i don't join the consulting company on oct 1st 2014, if another employer apply for my H1 COS again (assuming the consulting company don't revoke my H1) then will I have to visit India for stamping before joining the new firm ? jairichi
But what if the consulting company revoke my H1B ? I will lose H1 and again have to go through lottery right ? Revoking a H1B petition is immaterial in your case. Since you are cap subject once all your subsequent petitions are cap exempt till you reach 6 years combined stay in H1B and L1. Link to comment

Based on your current situation since your H1B petition was approved as COS you have to stop working for your L1 employer by 1st Oct. You have 60 days to report to H1B employer from 1st Oct. Any employer can file a cap exempt H1B petition anytime and if approved with an I94 you can join employer after 1st Oct. Link to comment

binu.sale
thank you so much for all your help! So I will have to visit India if H1 COS approved without I-94 through a new employer. My current COS is approved with a new I-94 Link to comment
