Employer asking i-797 copy

For some personal reason I need to quit my job and Change my status to H4.

My employer is asking to submit copy of i-797, so that they can inform immigration authorities about same.

 

1.What does that mean? Will that revoke my H1B visa or just that Petition?

2. If my employer do that, will I be able to come back to my H1b working status in future?

 

Pls guide. Thanks

1. Just the petition.

2. Yes you can.

 

Relax, that's the regular procedure  to follow. Employer has to revoke your petition once you resign.

1. By law an employer has to revoke your H1B petition once you stop working for them.

2. Yes, revoking a H1B petition will not affect your future H1B petitions.

As soon as you stop working, the employer by law has to inform USCIS, so that the H1 gets revoked. That is regardless if you give them a copy of the I-797 or not.

An H1 revocation is completely irrelevant for you. It has no effect on future H1s whatsoever. Don't listen to rumors that try to imply that H1 revocation is this scary thing. It isn't. It is a standard procedure required by law if the person on H1 is no longer working for the employer. It has no bad consequences.
