useranon Posted April 24, 2014 Report Share Posted April 24, 2014 Hi, I'm seeking the advise from the forum on my scenario. I have an approved I140 from an employer A EB3 (date not current yet). I joined Company B and later Company C without ever starting the GC process in company B. Company C yet to begin the process for my GC. However because of personal reasons I needed to relocate and found a job with a big firm but have been told by their immigration team that they cannot transfer my H1 because my I140 is not from my current employer © or the previous employer (B). So the following are my questions 1) Is there a limit on how many jobs one can change with a valid I140? 2) Is the job change to new employer any different from the job change from B to C? 3) Will there be a chance for RFE during H1 Transfer or future GC processing? No limit. 2. No, its not different 3. No one knows. For H1 ext or transfer beyond 6 yrs, all you need is a approved I140, I think it doesn't matter whether its from your previous employer or not. I have i-140 approved (and not revoked) from Employer A, and then I left the US. If I get a new offer from Emplyer B,, can I get B to file H1 extension with the approved i-140? Link to comment
