Hi Everyone,

 

I was on H4 and got my H1 approval since October 2013.

I was on leave for a few months and starting working in January 2014.

In March 2014, my employer said he couldn't pay me anymore and that I should file for COS to H4. Accordingly, I filed for a COS through my husband's company (He holds an H1B too).

Now, the H4 COS is still in process and I got another offer.

What should I do? Should I expedite the H1-H4 COS process? If yes, how? What are my other options?

Let employer file a cap exempt H1B petition and on approval just exit and enter with a valid H1B visa and I797. By doing this your COS to H4 would get canceled.
