PlzAdvice Posted April 23, 2014 Report Share Posted April 23, 2014 Hi , previously I was in US on an L1 visa (by Company A) for about 2.5 yrs, this visa expired, I applied for an extension which was denied. As a result, now I have returned back to India. Company B has applied an H1B visa for me, but I do not yet know if my application has been selected in the lottery. Now Company A , that I still currently work for is intrested in filing for my L1-B. Could you please let me know what are the rules related to applying both L1 and H1 at the same time. Also if H1 is not selected in lottery, will that in any way adversely impact my L1 application/processing , or if L1 gets rejected will that in any way adversely impact my H1 application/processing ? Lastly, if both get approved what choices do I have ? Link to comment

The extension was denied previously because of the inability to prove the "Specialized Knowledge" condition on L1B visa, through the documents that were submitted to USCIS. The reason I am thinking of reapplying for L1B too is that, I am still unaware of my application status on H1B (whether it gets selected during the lottery). Additionally, in the past few months, back in India, I have worked on certain project that adds to my expertise on the Specialised knowledge. Lastly, if you can, may I please request you to help me understand whether the denial of any 1 of these visa's, would adversely impact the other ?? Link to comment
